1. Acceptance of Terms

By accessing or using Powerlevel ("the Platform"), operated by Powerlevel ("we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Platform.

2. Eligibility

You must be at least 16 years old to use Powerlevel. By creating an account, you represent that you meet this age requirement and that all information you provide is accurate and complete.

3. Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You agree to notify us immediately of any unauthorized use. We reserve the right to suspend or terminate accounts that violate these Terms.

4. Platform Services

Powerlevel provides an AI-powered upskilling platform that includes course content, AI tutoring, career exploration tools, skill tracking, and digital badge credentials. Features may vary by subscription tier (Free, Starter, Pro, Enterprise).

5. Subscriptions and Billing

Paid plans are billed on a recurring basis (monthly or annually) via Stripe. You authorize us to charge your payment method at the start of each billing cycle. You may cancel at any time; access continues through the end of the current billing period. Refunds are provided only where required by applicable law.

6. User Content

You retain ownership of content you upload or create on the Platform (e.g., career profiles, resume data). By submitting content, you grant us a limited, non-exclusive license to use it solely for operating and improving the Platform. You must not upload content that is illegal, infringing, or harmful.

7. Intellectual Property

All Platform content, including course materials, software, design, logos, and trademarks, is owned by Powerlevel or its licensors. You may not copy, modify, distribute, or reverse-engineer any part of the Platform without our written consent.

8. AI Features

The Platform uses artificial intelligence to provide tutoring, career guidance, and content recommendations. AI-generated responses are for educational purposes only and should not be treated as professional, legal, or financial advice. We do not guarantee the accuracy of AI outputs.

9. Digital Badges and Credentials

Badges earned on the Platform are issued as Open Badges 3.0 verifiable credentials. Badges represent completion of specific learning activities on Powerlevel and are not accredited certifications. We reserve the right to revoke badges issued in error or through violation of these Terms.

10. Prohibited Conduct

You agree not to:

• Use the Platform for any unlawful purpose or in violation of any applicable law
• Attempt to gain unauthorized access to other accounts or Platform systems
• Interfere with or disrupt the Platform or its infrastructure
• Use bots, scrapers, or automated tools to access the Platform without our permission
• Share your account credentials or allow others to use your account
• Upload malicious code, viruses, or harmful content

11. Disclaimer of Warranties

The Platform is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the Platform will be uninterrupted, error-free, or free of harmful components.

12. Limitation of Liability

To the maximum extent permitted by law, Powerlevel shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform, including loss of data, revenue, or business opportunities.

13. Termination

We may suspend or terminate your access to the Platform at any time for violation of these Terms or for any other reason at our discretion. Upon termination, your right to use the Platform ceases immediately. Provisions that by their nature should survive termination will remain in effect.

14. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page with a new "Last updated" date. Your continued use of the Platform after changes constitutes acceptance of the updated Terms.

15. Governing Law

These Terms are governed by and construed in accordance with the laws of the United States. Any disputes shall be resolved in the courts of competent jurisdiction.
